RYAN, Circuit Judge. Action Distributing Company, Inc., a Michigan alcohol distributor, brought suit to vacate an arbitration award in favor of the defendant, International Brotherhood of Teamsters Local 1038. The award, rendered under the Labor Management Relations Act, 29 U.S.C. Â§ 185, interpreted the parties rights under a collective bargaining agreement. Both parties moved for summary judgment, and the district court found in favor of the defendant. Actions appeal asks this court to decide (1) whether the award Action seeks to vacate was barred, because of principles of res judicata and collateral estoppel, by an earlier arbitration award between the parties, and if not, (2) whether the award was drawn from the essence of the collective bargaining agreement.
